PRIVACY POLICY
Respecting your Privacy
Digs Reviews Pty Ltd (ACN 656 995 309) t/as Digs (Digs) is committed to supporting the National Privacy Principles for all fair handling of Personal Information which set clear standards for the collection, use, disclosure, storage of and access to Personal Information collected during the course of business operations and compliance with the Privacy Act 1988 (Commonwealth) and its amendments (the Act), and the Australian Privacy Principles (APPs) set out in that Act. The Digs App means the application known as ‘Digs’ which offers users a private and secure program for communication with others through leaving reviews and reading reviews left by others.
Personal Information means and includes your name, date of birth, gender, mailing or residential address, telephone number, email address, billing or payment information for example credit card number, name, expiry date and security code and bank account details, and any other information we collect from you when you create an account and register to use the Digs App.
We automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you use our App, we may collect information about the individual web pages or products that you view, what websites or search terms referred you to the website, and information about how you interact with the App. We refer to this automatically collected information as ‘Device Information’.
Our respect for your rights to the privacy of your personal information is paramount. We have policies and procedures in place to ensure that all personal information, no matter how or where it is obtained, is handled sensitively, securely and in accordance with the APPs.
This Privacy Policy sets out:
· What sort of personal information is collected and stored;
· How information is collected and used;
· What happens if you choose not to provide the required information; and
· How you can request access to the personal information we hold about you.
From time to time it may be necessary for Digs to review and revise this Privacy Policy. We reserve the right to change our policy at any time. Amendments or replacements of our Privacy Policy will be posted on our App. It is your responsibility to regularly review our Privacy Policy. Amendments will be effective immediately upon notification and updating on the App.
Collection of your Personal Information
By disclosing your Personal Information to us or using our App, you consent to its collection, use and distribution by Digs in a manner that is consistent with the Privacy Act and any other applicable data protection laws and this Privacy Policy.
We only collect personal information relevant to our business relationship with you so that we can provide our services and fulfill Digs’ functions and activities with respect to your access and use of the App and provide you with communications from our business associates that are relevant to you. We may collect your personal information:
(a) directly from you including via email;
(b) when your register an account on our App to use our App; and
(c) where you access and interact with our App.
We collect Device Information using the following technologies:
· “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier;
· “Log files” track actions occurring on the App, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps; and
· “Web beacons”, “tags”, and “pixels” are electronic files used to record information about how you use and browse our App.
Digs endeavours to only collect personal information about an individual from that individual, however Digs will use a third party app integration to monitor how you use and interact with the App and may obtain personal information from a third party as a result of the third party app integration. In some circumstances Digs may obtain personal information from a third party or check details against records kept by other parties.
Is your personal information secure?
Where you submit personal information, we manage it by using up-to-date techniques and processes that meet current industry standards to ensure that your personal information is kept secure and confidential. We also take measures to destroy or permanently de-identify personal information if it is no longer required.
Use and Disclosure of Personal Information
You acknowledge and consent that by providing your personal information to us that we may use and disclose your personal information for the purpose for which it was collected or for a related or ancillary purpose such as:
(a) supply of our services to you in accordance with our App terms and conditions including to facilitate, process, carry out and respond to your request, to manage, administer and enhance our services and to communicate with you;
(b) to our third party service providers to assist us in providing and improving our services to you and developing, improving and marketing our services to you;
(c) for regulatory reporting and compliance with our legal obligations, to various regulatory bodies and law enforcement officials and agencies to protect against fraud and for related security purposes;
(d) to identify you and conduct appropriate checks;
(e) set up, administer and manage our services and products and systems, including the management and administration of our App;
(f) to provide you with targeted advertisements or marketing communications we believe may be of interest to you;
(g) to our successors and/or assigns including to prospective purchasers and investors in our App; and
(h) as required by law.
We also use the Device Information that we collect to help us screen for potential risk (in particular, your IP address), and more generally to improve and optimize our App (for example, by generating analytics about how our account holders browse and interact with the App, and to assess the success of our marketing and advertising.
Anonymity and Pseudonyms
You have the right to remain anonymous or use a pseudonym when entering into transactions with Digs, unless such anonymity or use of a pseudonym would be considered unlawful or impracticable. Please let us know if you wish to deal with us anonymously or by a pseudonym, and where possible, we will accommodate this request. However, failing to provide your Personal Information may in some instances make it impractical or impossible to provide you with our products or services.
What happens if you do not want to disclose personal information?
You have no obligation to provide any personal information requested by us, but if you choose to withhold personal information, we may not be able to provide you with the services that depend on the collection of that information.
Providing Personal Information About Another Person
You represent to us that where you provide personal information to us about another person, company or organisation you are authorised to provide that information to us, and that you will inform that person who we are, how we use and disclose their information, and that they can gain access to that information.
Linked Sites
The Digs App may contain links to websites which are owned or operated by other parties. You should make enquiries as to the privacy policies of these parties. We are not responsible for information, or the privacy practices of such websites.
Direct Marketing
Digs will only use your Personal Information such as an address, email address and/or phone number for the purpose of direct marketing where we have obtained your consent to do so, or in circumstances where you would reasonably expect your Personal Information would be used or disclosed for this purpose. Direct marketing activities Digs may conduct include contacting you by way of phone calls, mail, email, SMS text messages, mobile message services MMS or instant messaging.
Where you have provided consent or would reasonably expect us to use your Personal Information for direct marketing, we may disclose Personal Information to third parties to allow them to direct market our products and their products and services to you in the ways described above. Your consent to receive direct marketing communications in the above ways will be deemed if you do not opt out when we offer you the opportunity to do so, and will remain current for an indefinite period of time unless and until you advise us otherwise. You can opt-out of receiving direct marketing at any time (see below).

Disclosures to third parties
Digs does not use or pass onto others any Personal Information without the consent of the individual(s) concerned other than for the primary purpose of collecting the Personal Information or a reasonably related secondary purpose which you would reasonably expect your Personal Information would be used or disclosed for direct marketing. For example we may provide your email address to a real estate company, removalist company or financial institution so that they can contact you directly to inform you about their services, programs, products and upcoming events.
Digs may commercially benefit from the disclosure of your Personal Information for a reasonably related secondary purpose and or we may sell the data we collect to third parties
By accepting the terms of our Privacy Policy you consent to receiving direct advertising and communications from us and our relevant service providers and the dealing with your personal information for a reasonable commercial purpose. You may make a request to not receive direct marketing material by forwarding an email to us at queries@digs.online.
How can you access your personal information?
You may request access to personal information that we hold about you. We will provide you with access to personal information in accordance with the Act and APPs and we may not grant you access to the personal information that we hold where the APPs allow us to do so. If you are refused access to information, we will provide you with reasons for the refusal.
